Pursuant to State Government Law Section 3-305(b), (8) to consult with staff, consultants
or other individuals about pending or potential litigation; “The County Commissioners held a
Closed Session on a motion of Commissioner Dumenil, seconded by Commissioner Corchiarino,
at 5:00 p.m. in the Office of the County Commissioners, The Liberty Building, 107 N. Liberty
Street, Centreville, Maryland.” The Board adjourned in Closed Session at 5:24 p.m. Those in
attendance were Mr. Todd Mohn, P.E., County Administrator, Ms. Stephanie Jones, Principal

County Commissioners held a Closed Session on a motion of Commissioner Dumenil, seconded
by Commissioner Corchiarino, at 5:25 p.m. in The Office of the County Commissioners, The
Liberty Building, 107 N. Liberty Street, Centreville, Maryland.” The Board adjourned in Closed
Session at 5:39 p.m. Those in attendance were Mr. Todd Mohn, P.E., County Administrator, and

the Board unanimously agreed to reappoint Mr. Gene Ransom to fill the vacancy on the Board of

will expire June 30, 2030.

On a motion made by Commissioner Wilson, seconded by Commissioner Dumenil, the
Board unanimously agreed to approve the amended agenda for the current meeting and the Regular
Minutes of May 12, 2026, Sanitary Minutes of May 12, 2026, Closed Session Minutes of May 12,
2026, Public Info Session Minutes of May 18, 19, and 20, 2026.

LEGISLATIVE:
COMPREHENSIVE WATER AND SEWER PLAN PUBLIC HEARING – MARLING
FARMS & DOMINION SEWER SERVICE AREA MAP:
Mr. Patrick Thompson, County Attorney, conducted the hearing on behalf of the
Commissioners and noted all legal requirements had been met.
Marling Farms & Dominion Sewer Service Area Map – The amendment seeks to adopt
the service area map for the Marling Farms Subdivision and the community of Dominion. The
areas in question have been noted as areas of Public Health Concern since at least the 1984
Comprehensive Water and Sewerage Plan, and every subsequent Plan since. Text briefly defining
the problem remains in the 2011 Plan. The service area will carry a sewer service designation of

S-3 (4 to 10 years) and the project will require a subsequent map amendment to S-2 should the
project proceed.
The Public Health Concern Maps were removed from the 2011 Plan to accommodate the
adoption of the remainder of the Plan. The map needs to be amended back into the Plan in order
to pursue a Public Health Exemption from the Smart Growth Coordinating Committee. This is a
State committee consisting of the Secretaries of each State department who will judge the merit
of the situation based upon a joint MDE and County presentation. As Marling Farms and
Dominion are not within the County’s designated Priority Funding Areas, we cannot access State
loan or grant funds which are essential to this project without this Exemption. When reaching out
to the State in regard to setting the groundwork for the Exemption hearing (MDE has to sponsor
the request on behalf of the County) the omission of the service area maps was raised as a fatal
flaw, so this amendment is a pre-requisite to pursuing the Exemption. Also noted, the service
area map will have to be amended from S-3 to S-2 if the project is to proceed.

County, the Queen Anne’s County Forest Conservation Act; bringing the Forest Conservation Act
into compliance with SB 526 and HB 1511 which articulate numerous changes to the Maryland
Natural Resources Title 5 Forest and Parks Subtitle 16 Forest Conservation § 5-1601 through §
5-1612; providing for definitions, rules of interpretation and purpose; providing for application of
the provisions, amendments thereto; providing for qualified professionals, general requirements
and a declaration of intent; providing for forest stand delineation, forest conservation plans,

COUNTY ORDINANCE NO. 26-06 - MAXIMUM IMPERVIOUS SURFACE RATIO IN
THE SUBDIVISION COMMERCIAL DISTRICT:
Commissioner Wilson introduced County Ordinance No. 26-06.
A BILL ENTITLED AN ACT CONCERNING An Increase to the Maximum Impervious Surface
Ratio for Commercial and Industrial Uses in the Subdivision Commercial (SC) District Which
Were in Operation Prior to December 31, 2025 in Queen Anne’s County, Maryland; FOR THE
PURPOSE of increasing the maximum impervious surface ratio for commercial and industrial uses
in the Subdivision Commercial (SC) Zoning District which were in operation prior to December
31, 2025, from 0.45 (45%) to 0.80 (80%); BY AMENDING §18:1 -21E.(2)(a)[1] of the Code of
Public Local Laws of Queen Anne’s County, Maryland;

PROCLAMATION NO. 26-09 MOTORCYCLE SAFETY AWARENESS MONTH:
Commissioner Dumenil read Proclamation No. 26-09 Motorcycle Safety Awareness
Month.
WHEREAS safety is our highest priority for the streets and roadways of our county; and
WHEREAS Queen Anne’s County is proud to be a supporter of motorcycle safety, education,
and awareness; and
WHEREAS motorcycles are a common and economical means of transportation that reduces
fuel consumption and road wear and contributes in a significant way to the relief of traffic and
parking congestions; and
WHEREAS, it is especially meaningful that the citizens of our county be aware of motorcycles
on the roadways and recognize the importance of motorcycle safety; and
WHEREAS the members of the Mid-Shore Chapter of ABATE of Maryland, Inc. continually
promote motorcycle safety, education, and awareness to the general public in our county and
state; and
WHEREAS all roadway users should unite in the safe sharing of roads throughout Maryland;
and

WHEREAS we encourage all motorists and citizens to join together in an effort to improve
safety and awareness on our roadways; and
NOW, THEREFORE, WE, THE COUNTY COMMISSIONERS OF QUEEN ANNE’S

Month.
MIDSHORE BEHAVIORAL HEALTH UPDATE:
Ms. Katie Dilley, CEO, Midshore Behavioral Health, and Ms. Sarah Fegan, Behavioral
Health Coordinator, Midshore Behavioral Health, presented to the Board their Annual Midshore
Behavioral Health Update along with their FY 2027 Letter of Agreement.
On a motion made by Commissioner McLaughlin, seconded by Commissioner
Corchiarino, the Board unanimously agreed to execute the Mid Shore Behavioral Health Fiscal
Year 2027 Letter of Agreement.

BOARD OF EDUCATION ADMINISTRATIVE BUILDING/VINCIT LOT 19-B
TRANSFER:
Mr. Lee Edgar, Chief of Engineering, Department of Public Works, submitted to the board
for their approval the Board of Education Administrative Building/Vincit Lot 19-B Transfer.
The newly constructed Administrative Office Building for the Queen Anne’s County Board
of Education is sited on a 4.737-acre parcel of land at 115 Vincit Street in Centreville as identified
in land records, Tax Map 44F, Parcel 60, Lot 19-B. This would transfer ownership to the Board

of Education and the adjacent, newly-created, 2.541-acre Lot 19-E would remain with County
Commissioners of Queen Anne’s County for future development.

ACTION ITEMS:
PETITION TO INTERVENE IN MARYLAND PUBLIC SERVICE COMMISSION CASE
NO. 9868:
Ms. Amy Moredock, director, Planning and Zoning, submitted to the Board for their
approval the Petition to Intervene in Maryland Public Service Commission Case No. 9868.
An application has been filed for a Certificate of Public Convenience and Necessity to
Construct three (3) Co-Located Solar Photovoltaic Generating Facilities Totaling 9.98 MW. This
project is sited on over 74 acres of an 87.3-acre parcel located within the Queen Anne’s County
Growth Area and the Town of Centreville’s Tier 2 Growth Area. It is located at the intersection
of Routes 301 and 304 on the west side of the highway off Little Farm Lane. The complete case
files may be accessed via Case No. 9868. This is a clear attempt to circumvent the standards found
in both MD Code, Public Utilities § 7-218(h)(3)(1) and Queen Ane’s County Zoning Code § 18:1-
57.2.A(5). Planning and Zoning recommended that the County intervene in this case. This
application is both inconsistent with the spirit and intent of MD Code, Public Utilities § 7-218 and
County Code § 18:1-57.2. Further to the point, upon submittal for site plan and permit review, the
County will process the application as a comprehensive project. County staff and the Town of
Centreville both agree that it will be beneficial to actively participate in the remaining steps in the
CPCN process, starting with filing a brief as an intervener prior to the 11 June 2026 deadline.

Board unanimously agreed to file a Petition to Intervene in the Application of TPE MD QA15A,
LLC, TPE MD QA15B, LLC, and TPE MD QA15C, LLC for a Certificate of Public Convenience
and Necessity to Construct 3 Co-Located Solar Photovoltaic Generating Facilities Totaling 9.98
MW in Queen Anne’s County, Maryland (Case No. 9868).

RESOLUTION NO. 26-07 – TEMPORARY MORATORIUM ON THE APPROVAL OR
PROCESSING OF APPLICATIONS FOR DATA CENTERS:
A RESOLUTION OF THE COUNTY COMMISSIONERS OF QUEEN ANNE’S COUNTY
ESTABLISHING A TEMPORARY MORATORIUM ON THE APPLICATION, APPROVAL
OF, OR PROCESSING OF APPLICATIONS FOR DATA CENTERS IN QUEEN ANNE’S
COUNTY;
WHEREAS, data centers are buildings or group of buildings, that may be large-scale, that
house computer systems and infrastructure used to process, store, and transmit vast amounts of
digital information and require substantial amounts of electricity, water, and land, and may place
significant strains on local energy grids, water resources and public infrastructure, while also
raising concerns regarding environmental impacts, noise and compatibility with residential and
other land uses;
AND WHEREAS, the need and desire for data centers have increased creating a greater
concern throughout the State of Maryland and nationwide;
AND WHEREAS, it is apparent that Queen Anne’s County’s existing zoning and other
regulatory framework does not sufficiently address and account for the scale, impacts and
operational characteristics of contemporary data center development;
AND WHEREAS, a strategic and temporary moratorium on the application, processing,
and approval of data center development would provide the County with the necessary time to
conduct comprehensive studies, engage with residents and stakeholders, and develop appropriate
policies, performance standard recommendations, and zoning regulations to guide future data
center development;
AND WHEREAS, the impact of data centers necessitates the need for a moratorium to
afford the County adequate time to study and draft a Zoning Code update for this land use;

AND WHEREAS, this moratorium is not intended to prohibit data center development
permanently but to ensure that where and if such development occurs, it does so in a manner that
is safe, sustainable, and in the best interests of the residents of Queen Anne’s County;
AND THEREFORE, BE IT RESOLVED this 26th day of May, 2026, by the County
Commissioners of Queen Anne’s County, Maryland, as follows:
Section 1. Neither the Queen Anne’s County Department of Planning and Zoning nor any
other County Department, Agency, Board, or Commission shall accept, process, or approve any
application, permit, or submittal for a data center in Queen Anne’s County for a period of twelve
(12) months from the data hereof.
Section 2. This moratorium is adopted to allow sufficient time for the County to
accomplish the following:
a. Conduct comprehensive studies and engage with residents and stakeholders;
b. Consider any revisions to the County Zoning Ordinance and any other
applicable County Ordinances, Policies or Regulations; and
c. Consider such other matters as the County Commissioners deem appropriate to
address the concerns recited herein.
Section 3. The County Commissioners shall have and reserve the right to extend or modify
this moratorium for such additional period or periods and on such terms and conditions as it deems
necessary for the health, safety, and welfare of the citizens of Queen Anne’s County.
Section 4. If any section, subsection, sentence, clause, or phrase of this Resolution or of
the codes hereby adopted are, for any reason, held to be unconstitutional, such decision shall not
affect the validity of the remaining portions of this Resolution or those codes.
Section 5. This Resolution shall become effective immediately upon its enactment.

CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP) – AGREEMENT
OF SALE AND PROJECT AGREEMENT – BIG OAK FARM, LLC:
Mr. Joe Pippin, Soil Conservation Aide/Easement Specialist, Soil Conservation District,
submitted to the Board for their approval the Conservation Reserve Enhancement Program
(CREP) – Agreement of Sale and Project Agreement – Big Oak Farm, LLC.
There are 97.535 acres of the 231.771-acre property owned by Big Oak Farm, LLC that is
ready to be submitted to the Maryland Department of Natural Resources for review and final
approval. Submission of the complete CREP package includes the Agreement of Sale and Project
Agreement to be signed by the County Commissioners. Total funding is being provided by the
CREP Easement program through Program Open Space, no County funds are being utilized. The
property is located within the County Priority Preservation Area and will add to the 616.373 acres
of CREP Easements that are already preserved.

Easement Agreement of Sale and Project Agreement for the property owned by Big Oak Farm,

Mr. Joe Pippin, Soil Conservation Aide/Easement Specialist, Soil Conservation District,
submitted to the Board for their approval the Conservation Reserve Enhancement Program (CREP)
– Agreement of Sale and Project Agreement – Robert Dean Roschy and Catherine Roschy Eastman.
There are 128.342 acres of the 305.208-acre property owned by Robert Dean Roschy and
Catherine Roschy Eastman, Successor Co-Trustees of the Trust created by the Last Will and
Testament of Robert P. Dean that is ready to be submitted to the Maryland Department of Natural
Resources for review and final approval. Submission of the complete CREP package includes the
Agreement of Sale and Project Agreement to be signed by the County Commissioners. Total
funding is being provided by the CREP Easement program through Program Open Space, no

County funds are being utilized. The Robert Dean Roschy and Catherine Roschy Eastman,
Successor Co-Trustees of the Trust created by the Last Will and Testament of Robert P. The
property is located within the County Priority Preservation Area and will add to the 616.373 acres
of CREP Easements that are already preserved.
On a motion made by Commissioner Corchiarino, seconded by Commissioner Wilson, the
Board unanimously agreed to execute the Conservation Reserve Enhancement Program (CREP)
Easement Agreement of Sale and Project Agreement for the property owned by Robert Dean
Roschy and Catherine Roschy Eastman, Successor Co-Trustees of the Trust created by the Last

There are 61.213 acres of the 122.506-acre property owned by Mar Del View Farms, LLC
that is ready to be submitted to the Maryland Department of Natural Resources for review and
final approval. Submission of the complete CREP package includes the Agreement of Sale and
Project Agreement to be signed by the County Commissioners. Total funding is being provided by
the CREP Easement program through Program Open Space, no County funds are being utilized.

BAY BRIDGE RUN 2026 MEMORANDUM OF UNDERSTANDING – MARYLAND
TRANSPORTATION AUTHORITY:
The annual Bay Bridge Run is scheduled for November 8, 2026. Each year we are required
to execute a Memorandum of Understanding with the Maryland Transportation Authority for the
event. The County Attorney has reviewed the MOU for legal sufficiency.

REQUEST FOR ECONOMIC DEVELOPMENT INCENTIVE FUNDING – TIDEWATER
DIRECT, LLC FORKLIFT TRAINING:
Ms. Heather Tinelli, Director, Economic & Tourism Development, submitted to the Board
for their approval the request for Economic Development Incentive Funding – Tidewater Direct,
LLC Forklift Training.
The Economic Development Incentive Fund (EDIF) Commission recommended the
approval of $1,599.00 in grant funding from the DIF Workforce Fund to Tidewater Direct, LLC
for forklift training. The training is provided by internal certified trainers at Tidewater Direct. The
overall cost of the training is $1,719.00. Tidewater Direct has implemented a standardized
workforce training program focused on the safe operation of powered industrial equipment.
On a motion made by Commissioner Wilson, seconded by Commissioner McLaughlin,
the Board unanimously agreed to approve the disbursement of $1,599.00 from the Economic
Development Incentive Fund workforce fund for forklift training to Tidewater Direct, LLC. This
disbursement of funds is contingent upon a signed agreement between the Economic Development
Incentive Fund Commission and Tidewater Direct and will outline the conditions of the agreement
and performance of the project.

REQUEST FOR ECONOMIC DEVELOPMENT INCENTIVE FUNDING – AGING
STRONGER:
Ms. Heather Tinelli, Director, Economic & Tourism Development, submitted to the Board
for their approval the request for Economic Development Incentive Funding – Aging Stronger.
Aging Stronger is purchasing a DEXA or body composition device that provides precise
body composition and bone health assessments that support early intervention and healthier aging.
This additional service offering will help drive higher client volumes and revenue, contributing
to local tax growth. The total project cost is estimated at $55,000.00, and Aging Stronger is
requesting $50,000.00 in EDIF funding to support this purchase. The remainder will be funded
by the owner. Currently, Aging Stronger employs one full-time staff member and three part-time
staff members and as a direct result of this equipment purchase, the company will create one
additional full-time position over the next three years.
On a motion made by Commissioner Corchiarino, seconded by Commissioner
McLaughlin, the Board unanimously agreed to approve an Economic Development Incentive Fund
Conditional Loan of up to $50,000 to Aging Stronger for their purchase of a DEXA device. The
disbursement of funds is contingent upon a signed agreement between the Economic Development
Incentive Fund Commission and Aging Stronger outlining the terms and conditions of the funding
and the project’s performance as submitted in the Economic Development Incentive Fund
application.

CLIFFORD HIGGS – TERMINATION OF OPEN SPACE EASEMENT & AMENDMENT

Mr. Doug Summers, County Planner, Planning and Zoning, submitted to the Board for their
approval the Clifford Higgs – Termination of Open Space Easement & Amendment Deed of Forest
Conservation Easement.
The owner is requesting approval to dissolve cluster lots 2-5 and Garrettson Lane.
Additionally, the owner is proposing to create slide lot 2 at 6 ac. The slide lot technique is permitted
within the zoning district (AG), and the subject parcel is permitted (1) slide lot based on acreage.
As the cluster lots are being dissolved and the slide lot technique does not require deed-restricted
open space, the current owner is seeking to terminate all open space that was required with the
original cluster lot subdivision. The owner is also seeking approval to decrease the amount of
protected forest area from 15.42 to the minimum amount required at 6.56 ac.
On a motion made by Commissioner Moran, seconded by Commissioner Corchiarino, the
Board unanimously agreed to execute the Termination of Open Space Easement and the Amended
Deed of Forest Conservation Easement for the Clifford Higgs Minor Subdivision plan.

WYE RIVER OYSTER PROGRAM:

for continuation of oyster reseeding in the Wye River.
